IT Act §3A — the legal basis

Section 3A of the Information Technology Act, 2000 recognises an electronic signature using a notified technique as legally equivalent to a handwritten one. Aadhaar OTP-based e-Sign is one such notified technique, governed by Schedule II of the Act and the e-authentication rules.

Foreign signatories — DocuSign / Adobe Sign

Non-residents typically don't have Aadhaar, so Captable falls back to a click-wrap signature via DocuSign or Adobe Sign, both of which carry recognition under the Indian Evidence Act read with Section 65B and the IT Act's electronic-record provisions.
